Terms and Conditions for “Live For The Ride” Lucky Draw Promotion Campaign 2019
1. These terms and conditions shall apply to the “Live For The Ride” Lucky Draw PromotionCampaign 2019 (“Promotion”) by Komoco Motorcycles Pte Ltd. (“Komoco”), ComfortDelGro Driving Centre (“CDC”) and Shell Eastern Petroleum (Pte) Ltd (“Shell”).
2. By registering or taking part in the Promotion, you agree to be bound by these Promotion Terms and Conditions and the decisions of Komoco, CDC and Shell in relation to and in connection with the Promotion.
3. The Promotion is from 1 October 2019 to 31 December 2019, 9am, both dates inclusive (“Promotion Period”).
4. Komoco, CDC and/or Shell reserves the right to change the Promotion Period, to withdraw, discontinue, terminate or alter the Promotion or the terms and conditions at any time at its and their sole discretion, without notice or liability to any person.
Eligibility
5. This Promotion is open to all Singapore citizens, permanent residents and foreigners residing in Singapore, who
i) Make a minimum nett spend of twenty-five Singapore dollars (S$25) at the Harley-Davidson of Singapore dealership located at 253 Alexandra Road #01-04, Singapore 159936 (the “HDS Dealership”) or,
ii) Make a transaction on Shell V-Power Nitro+, Shell FuelSave 98 or Shell FuelSave 95 (the “Selected Shell Fuels”) at any participating Shell station in Singapore with a valid Shell Escape Riders Card or,
iii) Enrol for any motorcycle course with CDC.
(collectively known as the “Eligible Customers”).
6. Customers at Shell stations in Singapore who transact using Shell Escape Card, Shell Value Care Card, Shell Value Drive Card and Shell Corporate Card are not eligible for the Promotion.
7. Employees of Komoco, CDC or Shell, and each of their advertising agencies (including, without limitation, any external auditor) who are directly involved in organizing or the conduct of the Promotion are not eligible to participate in this Promotion as determined by Komoco, CDC and/or Shell in its sole discretion.
8. Customers who do not have a valid Shell Escape Riders Card may apply to join and receive their Shell Escape Riders Card at any participating Shell station in Singapore.
9. Komoco, CDC and/or Shell have the absolute discretion to determine the eligibility of customers. Such determination shall be final and conclusive, and Komoco, CDC and/or Shell are not obliged to give any reason for its or their determination.
Promotion and Qualification
10. During the Promotion Period,
At Shell stations
i) One (1) scratch card will be awarded to Eligible Customers for a transaction on any amount of Selected Shell Fuels at any Shell station in Singapore. Issuance of scratch cards are limited to one (1) card per Eligible Customer per day and can only be done at the point of purchase.
ii) Each scratch card will entitle an Eligible Customer to one (1) chance to qualify in the Promotion upon successfully registering their unique scratch card codes found on the scratch card at https://tinyurl.com/livefortheride during the Promotion Period.
At HDS Dealership
iii) Every twenty-five Singapore dollars (S$25) spent in a single receipt at HDS Dealership will entitle an Eligible Customer to one (1) chance to qualify in the Promotion upon successfully registering their receipt number found on their transaction receipt at https://tinyurl.com/livefortheride. Multiple receipts cannot be combined to amount to twenty-five Singapore dollars (S$25).
At CDC
iv) Every enrolment for a motorcycle course at CDC will entitle an Eligible Customer to the following number of chances to qualify in the Promotion upon successfully registering their CDC learner identification number at https://tinyurl.com/livefortheride :

11. All information entered online must be accurate and valid; any Eligible Customer that submits inaccurate or invalid or misleading information shall be disqualified from the Promotion.
12. Scratch card
i) Customers who have a valid Shell Escape Riders Card are entitled to 10% off Harley-Davidson Motor Clothes at HDS Dealership upon presenting the scratch card at HDS Dealership during the Promotion Period.
ii) All scratch cards are neither transferable nor exchangeable for cash, credits, or for other goods and services, or otherwise, either partially or wholly.
13. Prize
i) There is only one (1) prize for this promotion - a customised Harley-Davidson Forty-Eight motorcycle estimated valued at S$30,900 (excluding Certificate of Entitlement (COE), ARF, road tax, insurance, registration fees, and other add-on options which shall be borne by the winner) (the “Prize”).
ii) Prize shown on any advertising materials are for illustration purposes only. The design and colour of the Prize may differ from the picture shown. The Prize is limited to the model specification with standard colour selection as determined by Komoco. Upgrade of any items (including but not limited to equipment, accessories and non-standard colours) will incur additional charges payable by the winner.
iii) Komoco reserves the right to, at any time and in its sole and absolute discretion without prior notice, replace and/or substitute the Prize with any other item of its or their choosing of similar value.
iv) The Prize is non-transferable, non-assignable, and non-exchangeable for cash, credits or other items.
14. Lucky draw
i) One (1) winner and nine (9) reserve winners for the Prize will be picked at random by Komoco (by manual or computerized means as HDS may determine) in public on the 15 January 2020 at 253 Alexandra Road #01-04, Singapore 159936 at 11am.
ii) The winner of the Prize will be notified through email at their registered email address and contacted via telephone (provided that a valid telephone number is given and captured in https://tinyurl.com/livefortheride by 17 January 2020 regarding the Prize collection details and for their consent to disclose or publish their information on Komoco’s website. Should the winner be uncontactable within twenty-four (24) hours or does not provide us with his/her consent for his/her information to be published on Komoco’s website, Komoco reserves the right and has the absolute discretion to award the Prize to the next reserve winner drawn by Komoco.
iii) The successfully notified winner of the Prize will be announced publicly by 24 January 2020.
iii) Prize collection period is by 24 February 2020, or within one (1) month of the winner being successfully notified. If the winner of the Prize does not acknowledge the Prize he/she has won by the end of such stipulated period, Komoco reserves the right and has the absolute discretion to award the Prize to the next reserve winner drawn by Komoco.
iv) The winner of the Prize must produce his or her email, phone number and/or Shell Scratch Card and/or HDS receipt where applicable for verification purposes before the Prize is issued.
v) Komoco, CDC and/or Shell reserves the right to disclose and publish the winner’s name (including photographs) for publicity purposes and the winner agrees to co-operate with and participate in the activities organized by Komoco, CDC and/or Shell for these purposes without additional compensation.
Participation and Personal Data
15. By participating in the Promotion, the Eligible Customers agree to be bound by the rules, regulations and decisions of Komoco, CDC and/or Shell, by the terms contained herein, and by any other applicable terms and conditions. Failure to comply with any of the foregoing will result in a disqualification for the Promotion.
The Eligible Customers are deemed to have consented to the collection, use and disclosure of his/her personal data by Komoco, CDC and Shell promoters and/or their respective contractors for verifying the eligibility of the Eligible Customers, contacting the Eligible Customers regarding the foregoing, and all purposes and promotions incidental to the Promotion. Eligible Customers agree to the collection, processing, use and storage of their personal data (which may include their names, mobile phone number, email address) by Komoco, CDC and Shell. If so selected by Shell, CDC and/ or Komoco, the personal data of Eligible Customers may be used in news features, marketing or publicity materials concerning this Promotion. Use, collection and disclosure of personal data by Komoco will be in line with Komoco’s privacy policy at http://www.harleysingapore.com/privacy-policy and any requests can be made via info@harleysingapore.com for the local Data Privacy Officer for Singapore, at http://www.harleysingapore.com/ or by calling the Komoco customer hotline (+65) 6475 0123 or at such number as updated by Komoco from time to time. Use, collection and disclosure of personal data by Shell will be in line with Shell’s privacy policy at https://www.shell.com.sg/privacy.html and any requests can be made via Eligible Cardmembers’ Shell account profile or communicate with Shell at SGP-DPO@shell.com for the local Data Privacy Officer for Singapore, at www.shellescape.com or by calling the customer hotline 1800 3722 733 or at such number as updated by Shell from time to time.Use, collection and disclosure of personal data by CDC will be in line with CDC’s privacy policy at https://www.cdc.com.sg/personal-data-protection/.
General
16. The decisions of Komoco, CDC and Shell on all matters relating to or in connection with the Promotion are final, conclusive and binding. Komoco, CDC and Shell shall not be obliged to give any reason or enter into any correspondence with any person on any matter concerning the Promotion.
17. Komoco, CDC and/or Shell reserve the right at any time in its sole and absolute discretion to determine and/or amend or vary these terms and conditions without prior notice, including but not limited to cancelling, terminating or suspending this Promotion, the eligibility terms and criteria, the selection of Prize winner, and the timing of any act to be done, and all Eligible Customers shall be bound by these amendments.
18. Komoco, CDC and/or Shell shall not be liable or responsible for any injury, loss or damage suffered as a result of, or in connection with the Promotion howsoever arising, including but not limited to, the qualification of Eligible Customers, the submission mechanism, redemption, fulfilment of and use of the Prize, the quality or fitness for use of the Prize, any breakdown or malfunction in any computer system or equipment, any notice which is misdirected and/or lost in the post, loss of income, profits or goodwill, as well as any other direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties howsoever arising whether in contract, tort, negligence or otherwise. For the avoidance of doubt, cancellation, termination or suspension by Komoco, CDC and/or Shell of this Promotion shall not entitle any party to any claim or compensation against Komoco, CDC or Shell for any and all losses or damage suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension.
19. In the event of any inconsistency between these terms and conditions and any advertising, promotional, publicity and other materials relating to or in connection with the Promotion, these terms and conditions shall prevail.
20. The Promotion and these terms and conditions shall be governed by the laws of the Republic of Singapore and all Eligible Customers are deemed to have agreed to submit to the exclusive jurisdiction of the Singapore Courts.
21. A person who is not a party to any agreement governed by these terms and conditions shall have no rights under the Contracts (Rights of Third Parties) Act (Cap 53B) to enforce any terms of such agreement.
